Refund Policy

Introduction

This Refund Policy ("Policy") applies to all purchases made on the ThioSuxa platform (accessed via www.thiosuxa.com, referred to as the "Platform") and forms part of the Agreement between You (the "Learner") and ThioSuxa (the "Creator"). Capitalised terms used but not defined in this Policy shall have the meaning given to them in our Terms of Use.

This Policy should be read together with our Terms of Use and Privacy Policy.

1. General Policy

ThioSuxa provides digital educational content for which access is granted immediately upon successful payment. As a general rule, all Content Fees paid for access to any Content on the Platform are final and non-refundable.

Before purchasing, Learners are strongly encouraged to:

  • (a) Review the product description, curriculum, format disclosures, and scope of Content on the relevant product page;
  • (b) Access any free sample content (such as "Ace EDAIC — Free Preview" or equivalent sample packs) offered on the Platform to evaluate Content quality, style, and suitability;
  • (c) Review the applicable Terms of Use and this Refund Policy prior to purchase.

By completing a purchase, the Learner acknowledges that access to digital Content has been provided and that Content Fees are non-refundable save as expressly set out in this Policy.

2. Limited Exceptions — When Refunds May Be Granted

Notwithstanding the general non-refund rule in Section 1, ThioSuxa will consider refund requests in the following specific circumstances:

2.1 Duplicate or Erroneous Charges

Where a Learner has been charged more than once for the same Content due to a payment processor error, or where a clearly erroneous charge has been made, the excess or erroneous amount will be refunded upon verification.

2.2 Technical Inability to Access Content

Where ThioSuxa is unable to provide access to purchased Content for a continuous period exceeding seventy-two (72) hours due to a fault attributable to ThioSuxa or its primary infrastructure provider, and where such fault cannot be reasonably remedied, the Learner may request a pro-rated refund for the affected subscription period. This exception does not apply to:

  • (a) Outages caused by the Learner's own device, network, or connectivity issues;
  • (b) Scheduled maintenance announced in advance;
  • (c) Force majeure events as described in our Terms of Use.

2.3 Material Defects in Content

Where Content contains material defects (such as systematically incorrect answer keys, broken or inaccessible media files, or substantial factual errors) that render the Content unusable for its intended educational purpose, and where ThioSuxa is unable to rectify such defects within a reasonable time after being notified, a pro-rated refund may be granted at ThioSuxa's discretion.

Isolated errors, minor inconsistencies, or content that a Learner finds difficult, unhelpful, or not aligned with personal study preferences do not constitute material defects.

2.4 Statutory Consumer Rights

Where applicable law grants the Learner a statutory right to refund, withdrawal, or cancellation that cannot be contractually waived, ThioSuxa will honour such rights to the extent required by law. This includes, without limitation:

  • (a) Learners in the European Union, European Economic Area, and United Kingdom: The statutory right of withdrawal does not apply to digital content purchases where access has commenced with the Learner's express consent and acknowledgment, in accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and equivalent UK regulations. By purchasing digital content on the Platform and accepting these terms at the point of purchase, the Learner expressly consents to immediate access and acknowledges the waiver of this statutory right. Where such express consent and acknowledgment has not been validly obtained, the statutory 14-day right of withdrawal shall apply in accordance with applicable law.
  • (b) Learners in India: Any rights available under the Consumer Protection Act, 2019 and associated regulations for digital goods.
  • (c) Other statutory rights under the applicable laws of the Learner's jurisdiction.

3. Circumstances Where Refunds Will NOT Be Granted

For clarity, ThioSuxa will not refund Content Fees in the following circumstances:

  • (a) Change of mind, buyer's remorse, or loss of interest in the Content after purchase;
  • (b) The Learner's personal examination outcome, including failure to pass an examination, irrespective of any engagement with Platform Content;
  • (c) Perceived difficulty of the Content or a Learner's personal preference for a different teaching style, format, or pedagogical approach;
  • (d) Inability to complete Content within the subscription period due to the Learner's own schedule, health, or personal circumstances;
  • (e) Dissatisfaction arising from features, formats, or limitations that were accurately disclosed on the product page prior to purchase (including, without limitation, the Multi-Correct Response (MCR) format used in certain Content such as Ace EDAIC, as disclosed in Section 9.6 of the Terms of Use);
  • (f) Partial consumption of Content, non-use of Content, or lapse of subscription time;
  • (g) Termination of access for cause under Section 11 of the Terms of Use (including breach of Agreement, account sharing, fraud, or chargeback);
  • (h) Refund requests made after the expiry of the Learner's subscription period;
  • (i) Purchases of sample, preview, or free-tier Content (which involve no payment);
  • (j) Any circumstance not expressly covered in Section 2 above.

4. How to Request a Refund

Refund requests must be submitted in writing to grievance@thiosuxa.com and must include:

  • (a) The Learner's full name and registered email address;
  • (b) Order ID or transaction reference number;
  • (c) Date of purchase;
  • (d) The Content for which a refund is requested;
  • (e) A clear description of the grounds for the refund request, with reference to the applicable sub-section of Section 2;
  • (f) Any supporting documentation (such as screenshots of errors, transaction receipts, or correspondence).

5. Refund Processing

5.1 Acknowledgement and Review

ThioSuxa will acknowledge receipt of a refund request within three (3) business days of submission and will communicate a decision within fourteen (14) business days of receiving all required information.

5.2 Verification

ThioSuxa reserves the right to verify the circumstances underlying a refund request, including but not limited to reviewing Platform usage logs, access records, and payment processor data, before approving a refund.

5.3 Refund Amount

Where a refund is granted:

  • (a) Duplicate or erroneous charges: Refund of the excess or erroneous amount in full;
  • (b) Technical inability to access Content (Section 2.2): Pro-rated refund based on the affected portion of the subscription period;
  • (c) Material defects (Section 2.3): Pro-rated refund at ThioSuxa's discretion, or alternatively, access extension or Content replacement where practicable;
  • (d) Statutory rights (Section 2.4): Refund in accordance with the applicable statutory requirement.

5.4 Refund Method

Approved refunds will be processed through the original payment method used at the time of purchase. ThioSuxa does not issue refunds in cash, to alternative payment methods, or to third-party accounts.

5.5 Processing Time

Once approved, refunds are typically processed within seven (7) to fourteen (14) business days, subject to the policies and processing times of the relevant payment processor and the Learner's card issuer or bank. ThioSuxa is not responsible for delays attributable to payment processors or financial institutions.

5.6 Access Revocation Upon Refund

Upon approval and processing of a refund, the Learner's access to the refunded Content will be immediately and permanently revoked. Continued use of, or attempts to access, refunded Content thereafter constitutes a material breach of the Terms of Use and may result in account termination and legal action.

6. Chargebacks and Payment Disputes

Learners who initiate a chargeback, payment reversal, or dispute with their card issuer or bank in respect of a purchase on the Platform, without first contacting ThioSuxa at grievance@thiosuxa.com and exhausting the internal refund review process in Sections 4 and 5, will be considered in breach of this Policy and the Terms of Use. ThioSuxa reserves the right to:

  • (a) Immediately suspend or terminate the Learner's account;
  • (b) Contest the chargeback with supporting documentation;
  • (c) Recover any costs, fees, or chargeback penalties from the Learner;
  • (d) Permanently refuse future access to the Platform.

7. Free Preview and Sample Content

Free Content offered on the Platform (including "Ace EDAIC — Free Preview" and any similar sample packs, demo modules, or preview questions) is provided at no cost and involves no payment. Accordingly, this Policy does not apply to such free Content, and no refund can arise in respect of it.

ThioSuxa reserves the right to modify, suspend, or discontinue free Content at any time without notice and without obligation to affected users.

8. Modifications to This Policy

ThioSuxa reserves the right to modify this Refund Policy at any time. Material changes will be notified via the Platform or email. The "Last Updated" date at the top of this Policy indicates when the most recent changes were made. The Policy in force at the time of Your purchase governs that purchase; subsequent changes do not apply retrospectively.

9. Governing Law and Dispute Resolution

This Policy shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to this Policy shall be subject to the dispute resolution and jurisdiction provisions set out in Section 15 of the Terms of Use.
